Flow My Data, LLC (“Flow My Data,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information in connection with our website at flowmydata.com (the “Site”) and the professional services we provide, including workflow automation, AI software development, and eCommerce consulting (collectively, the “Services”).

1. Who We Are & Scope

In plain English: This policy covers the information we handle as a business — mainly the details of prospects and clients who contact us or hire us. It is not about running a platform that stores your customers' data, because we don't operate one.

Flow My Data is a Tennessee limited liability company that provides workflow automation, AI software development, and eCommerce consulting services to businesses. This Privacy Policy applies to personal information we collect from visitors to our Site, from prospective clients who contact us or book a call, and from clients who engage us for Services.

This policy does not create any commitment to process personal data on your behalf. Where an engagement requires us to access or handle personal data that belongs to a client or its customers, that handling is governed by the applicable client contract and Statement of Work, as described in Section 2.

2. Our Role & How We Handle Client Data

In plain English: For our own website and business, we're the “controller” of your information. When we build systems for a client, we're providing labor — we don't host or manage your customers' data on an ongoing basis, and any temporary access we need is governed by our contract with that client.

For personal information collected through the Site and in the ordinary course of running our business (for example, prospect and client contact details, billing information, and marketing analytics), Flow My Data acts as a data controller and determines how and why that information is used.

Flow My Data delivers Services as professional labor: we design, build, and configure systems for our clients. We do not operate a software platform that stores or manages our clients' end-user data on an ongoing basis. During an engagement we may be given limited, temporary access to a client's systems, accounts, or data solely to perform the work requested. When we do, we act as a service provider / processor and handle that data only on the client's documented instructions and only as permitted by the governing client contract and Statement of Work. We do not use client or end-user data for our own purposes. Where required, the parties will put a data processing addendum in place.

3. Information We Collect

In plain English: What you give us (contact and billing details), what you send us during a project, and basic technical data your browser shares automatically.

Information you provide to us. When you complete a contact or lead form, book a call, request a proposal, or become a client, we collect information such as your name, business name, email address, phone number, and the details of your inquiry or project. If you engage us, we also collect billing and payment information necessary to invoice you.

Information provided during an engagement. To perform the Services, clients may share business materials, credentials, and access to systems. Any personal data contained in those materials is handled under Section 2.

Information collected automatically. When you visit the Site, we and our analytics and advertising partners automatically collect certain technical information, including IP address, device and browser type, pages viewed, referring URLs, and interactions with the Site, through cookies and similar technologies (see Section 6 and our Cookie Policy).

4. How We Use Information

In plain English: To answer you, deliver and bill for our work, run and improve our business, keep things secure, and — for the Site — to market our Services.

We use personal information to: respond to inquiries and provide proposals; deliver, manage, and invoice for the Services; communicate with you about your project or account; operate, maintain, and improve the Site and our business; comply with legal, tax, and accounting obligations; protect the security and integrity of our Site and systems; and, for prospects and clients, send marketing communications about our Services (from which you can opt out at any time).

5. AI & Model Training

In plain English: We don't feed your data or your project materials into AI models to train them.

Flow My Data does not use client data, engagement materials, or personal information collected through the Site to train, fine-tune, or otherwise develop general-purpose artificial intelligence or machine learning models. Where an engagement involves building or configuring AI systems, any use of a client's data for that client's own models is defined in, and limited by, the governing Statement of Work.

6. Cookies & Tracking

In plain English: We use cookies on our website, including analytics and advertising cookies, and you can control the non-essential ones.

We use cookies and similar technologies on the Site for essential functionality, to remember preferences, to measure performance, and to support our advertising. You can accept or decline non-essential cookies through our consent banner. For full details, including the specific providers involved, see our Cookie Policy.

In plain English: We share information only with vendors who help us operate, when the law requires it, or in a business transfer — never sold for advertising.

We share personal information only as follows: with service providers and vendors that support our business (for example, hosting, payment processing, email, scheduling, CRM, and analytics/advertising partners), under contracts that limit their use of the information; with professional advisors such as accountants and lawyers; with authorities or other parties where required by law or to protect our rights; and in connection with a merger, acquisition, financing, or sale of assets, in which case we will notify affected individuals as required. We do not sell personal information for money. Certain advertising cookie activity may be considered “sharing” under California law — see Sections 8 and 14 and our Cookie Policy.

8. Analytics & Advertising Partners

In plain English: We use Google and Meta and LinkedIn tools to understand our website traffic and to reach the right prospects, and you can opt out.

To measure Site performance and to attract and convert prospects, we use the following third-party tools: Google Analytics 4 and Google Ads (governed by Google's Privacy Policy; opt out via Google Ads Settings and the Google Analytics Opt-out Browser Add-on), Meta (Facebook) Pixel (governed by Meta's Privacy Policy; manage via Meta Ad Preferences), and the LinkedIn Insight Tag (governed by LinkedIn's Privacy Policy; manage via your LinkedIn ad settings). These partners may set cookies and receive information about your visit to enable measurement and advertising, including cross-site retargeting. You can also control these technologies through our consent banner and industry opt-out tools such as the DAA WebChoices and NAI pages.

In plain English: If you interact with us on social platforms, those platforms have their own privacy rules.

Flow My Data maintains profiles on platforms including YouTube, LinkedIn, X, Facebook, and Instagram (@flowmydata). If you interact with us on these platforms, your interactions are governed by the privacy policies of the respective platform. For our Facebook Page, Meta may act as a joint controller for certain page-insights data.

10. Data Retention

In plain English: We keep information only as long as we need it for the purpose we collected it, plus what the law requires.

We retain personal information for as long as necessary to fulfill the purposes described in this policy. Prospect information is retained while we pursue and maintain a business relationship. Client project records, contracts, and billing information are retained for the duration of the engagement and for the period required by our legal, tax, and accounting obligations, after which they are deleted or anonymized. Any temporary access to a client's data granted during an engagement is relinquished at the end of the engagement in accordance with the governing contract.

11. Security

In plain English: We take reasonable steps to protect information, but no system is perfectly secure.

We maintain administrative, technical, and organizational safeguards designed to protect personal information, including access controls, encryption in transit where appropriate, and limiting access to those who need it. When we are given access to a client's systems, we follow the security requirements set out in the governing contract. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12. International Data Transfers

In plain English: We operate from the United States, and if your data comes from abroad it will be transferred here under appropriate safeguards.

Flow My Data operates from the United States, and personal information we collect is processed there. If you access the Site or engage us from outside the United States, you understand that your information will be transferred to and processed in the United States. Where required for transfers from the EEA, UK, or Switzerland, we rely on appropriate safeguards such as the Standard Contractual Clauses and, for the UK, the International Data Transfer Addendum.

In plain English: If you're in the EU or UK, you have rights to see, correct, delete, and export your data, and to object to certain uses.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the right to access, correct, delete, restrict, or object to the processing of your personal information; to data portability; and to withdraw consent where processing is based on consent. 14. California Privacy Rights (CCPA / CPRA)

In plain English: If you're a California resident, you can ask what we've collected, have it deleted or corrected, and opt out of ad-related “sharing” — with no penalty for asking.

If you are a California resident, you have the right to know what personal information we collect and how we use and disclose it; to request access to, deletion of, and correction of your personal information; and to opt out of the “sale” or “sharing” of personal information (we do not sell personal information for money, but certain advertising cookie activity may constitute “sharing”). 15. Children's Privacy

In plain English: Our business is for other businesses; we don't knowingly collect data from children.

The Site and Services are directed to businesses and are not intended for children. We do not knowingly collect personal information from individuals under 13 (or under 16 where applicable). If you believe a child has provided us personal information, contact us and we will delete it.

16. Do Not Track & Global Privacy Control

In plain English: Browsers can send “don't track me” signals; we honor the GPC opt-out signal where required and offer cookie controls either way.

The Site does not respond to traditional “Do Not Track” browser signals because no common standard exists. However, where required by law, we treat a Global Privacy Control (GPC) signal as a valid request to opt out of the “sharing” of personal information for the browser sending it. You can also manage cookies through our consent banner.

In plain English: We link to other sites sometimes, and we're not responsible for their privacy practices.

The Site may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites, and we encourage you to review their privacy policies.

In plain English: If we change this policy, we'll update the date, and we'll give notice of significant changes.

We may update this Privacy Policy from time to time. We will post the revised version with a new “Last Updated” date, and where changes are material we will provide additional notice as required by law. Your continued use of the Site after the effective date constitutes acceptance of the updated policy.
